Eminent Domain Authorized as ‘Last Resort’ in Right of Way Acquisition of Shorey Road

The Board of County Commissioners authorized the right to acquire adjacent property to Shorey Road in Chehalis under the threat of eminent domain if deemed necessary.

The road has been selected for a safety improvement project using Federal Highway Safety Improvement Program Funding.

The project, which aims to benefit the public by creating a safer road, will require additional road right of way from adjacent property owners in some areas for the road improvement.



Larry Unzelman, county real estate services director, said the threat of eminent domain is a tool for the county as “a very last resort.”

“We do negotiate in good faith with the property owners as long as we can,” he said.

Tim Fife, assistant county engineer, said the project will include slope flattening.
