A Winlock man accused of pointing a realistic-looking BB gun at a man who told him to leave his property on July 10, 2024, has been charged with second-degree assault in Lewis County Superior Court.
Michael D. Wolfe, 19, and another man are accused of going onto a property in the 2500 block of state Route 508 and “hollering for a female who lives on the property,” according to court documents. When the property owner confronted the men, Wolfe allegedly “pulled out a gun … pointed it at him and told him to back up,” according to court documents.
The property owner called 911 after the men left the property.
He reportedly told responding Lewis County Sheriff’s Office deputies that he believed the gun was a real 9 mm or .22 handgun.
Deputies contacted the men near the property and identified the gun, which was in Wolfe’s coat, as a CO2-powered BB gun.
A deputy “noted the BB gun did not have any indicators that it was a BB gun, and that it appeared to be a firearm,” according to court documents.
When questioned about the incident, the men allegedly said they had been in contact with the ex-girlfriend of one of Wolfe’s relatives when the property owner told them to leave.
“They stated (the property owner) was aggressive in nature, so Mr. Wolfe drew the BB gun, pointed it at him and told him to back up,” according to court documents.
Wolfe was charged March 3 in Lewis County Superior Court with one count of second-degree assault, which is a class B felony punishable by up to 10 years in prison.
He was issued a summons notice for a March 18 preliminary hearing, which he was present for.
All parties agreed Tuesday to allow Wolfe to remain out of custody on $10,000 unsecured bail.
Arraignment is scheduled for Thursday, March 27.
