A man accused of breaking into an unoccupied Toledo home on Wednesday was arrested after the homeowners’ son found him in the residence, punched him several times and restrained him until police arrived.

Trevor B. Duff, 39, was booked into the Lewis County Jail at approximately 10:42 p.m. on Dec. 18, according to jail records. He was charged Dec. 19 in Lewis County Superior Court with one count of first-degree burglary.

Duff was arrested after Lewis County Sheriff’s Office deputies responded to a report that a man had found a stranger inside his parents’ house in the 400 block of Drews Prairie Road while his parents were out of town, according to charging documents.

The homeowners’ son advised that “the male came at him so he punched the male.”

According to the homeowners’ son, his parents had asked him to check on the house while they were out of town. He reportedly entered the house through the back garage door and “observed the TV was on in the residence,” and then saw a man, who was later allegedly identified as Duff, “sitting in his dad’s living room chair.”

Duff allegedly “started rushing towards (the homeowners’ son) in a manner he believed was aggressive and assaultive” and “put his hands on him in a pushing manner,” according to court documents.



The homeowners’ son said he then “punched the male subject in the face” and, when Duff allegedly “continued to rush back at him,” punched him “a few more times and pinned him to the ground before calling 911,” according to court documents.

Responding deputies found Duff “laying on the floor” inside the residence “with a large injury to his left eye area,” according to court documents.

Duff allegedly “would not tell (a deputy) why he was there,” but did allegedly tell the homeowners’ son that “he drank some beers.”

The homeowners have since confirmed that some food and several beer bottles had been taken. Deputies located empty beer bottles near where Duff was allegedly seen sitting and located other empty beer bottles and food packages in the garage.

Duff’s bail is set at $10,000. Arraignment is scheduled for Thursday, Dec. 26.
