A Bellingham man is suspected of recording a woman performing a sexual act on him in a school parking lot without her knowledge and later sending the video to her through Instagram.
Elias Guzman, 20, has been charged in Whatcom County Superior Court with first-degree voyeurism, court records show. Jail records show Guzman was booked into Whatcom County Jail and released Friday, Oct. 15.
The Bellingham Police department was notified that on Jan. 20, Guzman and the victim were in the parking lot at Kulshan Middle School when she performed a sexual act on him, court documents state.
Later that evening, the victim reported that Guzman sent her a video of the act through Instagram, according to documents.
The victim reported calling Guzman to ask why he would send her the video, documents state, and Guzman responded that he thought the victim might want to see it. The victim also reported that she never saw a phone in Guzman's hand and that she had no idea he was recording.
Police spoke to Guzman, who said he showed the victim the video right afterward, documents state, and he confirmed that he recorded the act "in the moment," rather than talking to the victim about recording it.
A summons for Guzman's arrest was issued on Aug. 31, court records show, and he was scheduled to make his first appearance and be arraigned Friday. A trial has been scheduled for Dec. 27.
