County Will Settle One Claim; Deny Another

The county will pay out $753.50 to Josh Brooks, a man whose RV was damaged at the Southwest Washington Fairgrounds.

According to Risk Management Director Paulette Young, an improperly secured door to a storage area banged against the RV repeatedly and caused damaged.

"We're just going to pay it," she said at a meeting on Tuesday. "It is what it is."

Lewis County will deny the $3,298.54 claim from Tom Rarey, whose vehicle was damaged during a collision with a county brush cutter, Young said.

The brush cutter — while attempting to make a u-turn — ran into the side of Rarey's vehicle. The citizen was attempting to pass on the left of the brush cutter when the accident occurred.

Lewis County sheriff's deputies responded to the scene; no citations were issued.

According to Young, the incident took place in a passing zone.

The Lewis County Public Works department has asked Risk to deny the claim based on two regulations: one imposes limitations on passing on the left; the other provides some protection for highway construction and maintenance.

"Both of (the laws) basically give our brush cutter the right of way at that point in time," Young said.

Rarey's low-estimate request is for $3,298.54.

Blue Book value for the vehicle, in excellent condition, is $2,520, Young said.
