An alleged sexual assault victim and prosecutors involved in the now dismissed Everett Fairchild case spoke out this week on the need for a true verdict after charges were dropped before trial.
Charges of fourth-degree assault with sexual motivation and three counts of indecent exposure against Fairchild were dismissed Aug. 6, after Lewis County Superior Court Judge R.W. Buzzard declared that the prosecution filed various motions too late for a constitutionally sound speedy trial.
Lewis County Prosecutor Michael Golden said the judge’s decision may be a conflict between a local rule, stating that motions cannot be filed after pre-trial hearings, and a state rule, allowing for motions to be filed any time before a verdict.
Just before the case was dismissed early this month, Deputy Prosecutor Shane O’Rourke argued that a list of witnesses and their expected testimonials from Fairchild’s defense was late, but Buzzard batted the argument down as well as a motion requesting that the trial be continued into September.
Though Golden filed a motion for a renewal of the case Friday afternoon, he said he won’t know whether appeals will be filed until Buzzard releases his official findings in the case.
“We need to get this issue resolved,” Golden said Thursday. “This is the first time we’ve had a dismissal like this based on the rule.”
Jonathan Meyer, one of Fairchild’s defense attorneys in the case, said he expects the new motion for renewal to be dropped.
Meyer said he was also never given a list of expected testimonies from witnesses. That said, he expects an appeals process would be unsuccessful.
“(The prosecution) can try, but I think the judge made the right decision,” Meyer said. “In fact, I think he made the only decision he could given the facts.”
He also disagreed with the argument that the local rule conflicts with the state rule regarding motion filing.
Golden said his office is likely to appeal further should his motion for renewal be denied.
The Alleged Victim
Everett Fairchild, 48, was suspected of sexual assault after his alleged victim and Green Hill School co-worker Christy Reed told detectives that he showed her his genitalia and groped her on multiple occasions.
Though the case is dismissed, Reed said Thursday that she wasn’t afraid of further misconduct.
She said Fairchild is still on paid leave “working from home” since the allegations were cast, and won’t be working in her department anymore.
If prosecutors need her to testify again, she said she’ll be there.
“It’s not like the case got dismissed because of lack of evidence,” she said. “The guy did what he did, I’m not a liar.”
She said she’s happily married to a different Green Hill employee and had no reason to lie. She alleged that she was just fed up with the abuse.
The judge’s decision that the prosecution had a mishap doesn’t bother her, she said, because Fairchild won’t be in contact with her regardless.
“Whether he goes to jail or not, he knows he got caught,” she said. “If he gets off, it was by the skin of his teeth.”
Multiple calls to Fairchild’s home were not returned by The Chronicle’s press time.

You would be doing a favor for many!!Also Kudos to the Chronicle for keeping up on printing these stories. The public needs to see how messed up our Justice System is and do something about it!! As far as Fairchild goes, its just a matter of time before he slips up again. This type of psychotic behavior doesn't just go away, in fact it will probably get worse and some other poor woman or young girl will be victimized again.You very few Fairchild supporters need to look into public records and see what kind of person you are backing. He would stab you in the back at first opportunity, so don't feel so secure.Funny thing is...the truth always has a way of coming out and it surely will in this situation too. Fairchild cant keep his stories straight long enough and he will manage to "EXPOSE" himself to everyone eventually.Other people will fed up and come forward eventually and he will do the time for crimes.

I don't know the "evidence" of the case, or who's side of the story to believe. I can say I worked with both Everett, and Christy at GHS, and respected them both. Neither ever acted unprofessional that I ever observed, and both were some of the better staff I worked with there.I can also say that Christy is very believable when she claims there was interference from GHS staff who were taking sides, or were just fearful of her becoming a whistleblower. The old boy club is alive and well at GHS, and anyone who doesn't believe this is either blind, stupid, or part of the club.

I am a newhire at GHS and at the beginning of my employement, I had to take a defensive tactics class where Ms. Reed was one of the instructors. I was shocked at her behavior and demeanor during this training, She repeativly made references that I felt crossed the line of professionalism and at times, she made me feel uncomfortable. As an instructor, she was very loud and demanding of the males in our classes attention and I felt she didn't act as a professional should. Even at one point she went on to tell some of us in her class about these allegations that she made against Mr. Fairchild. Being a new hire, I felt this was wrong ,as I wasn't even sure who this person was or the facts in the situation. It was almost as if she wanted to make sure that we all knew she was the victim and that this man was a sexual predator. I learned after the class more of the matter and the general feeling of others about Ms. Reed and her behavior with other male staff on the hill. In my opinion, she did not act like a victim and was almost giddy with the telling of her stories. I haven't been there long enough to know what is true and what isn't and I haven't even met Everett Fairchild. But the training I took with her left a lasting impression in my mind.

I had to respond for no other reason than I find it funny how people who don't know either person or have limited information are so easy to pass judgement and make justifcations for this case being dismissed. I know it might be foreign for this newspaper, but how about we wait and read Judge Buzzard's written findings and decision and go from there. What the readers need to remember is that only one side has been heard here.So of course, it must all be the truth. Because we know the Chronicle always prints the truth. (insert chuckle here) Ms. Reed has a right to speak her mind, but so does the other side. Once all the air clears whether that be from winning an appeal or appeal being denied. The PUBLIC will know who the real victim is and who the victim isn't. The amount of documentation and witnesses to show Ms. Reed for the "real" person she is, will be made available to ALL through public records. I encourage all the readers to sit back and wait and listen to ALL evidence before you pass judgement on a man without hearing from both sides. Ms. Reed has made these allegations against two other men and was frequently at the Fairchild home for various reasons, contrary to what she would like to admit too. The witnesses that the Fairchild's have are people who know both Mr. Fairchild & Ms. Reed and have witnessed her behavior at work, at the Fairchild home and other places that they all were together. So please Ms. Reed live in the "I am a helpless, innocent victim spot light" because it will be short lived. Ms. Reed is always portraying herself the victim...first it was when she accused another staff of the same thing, then it was issues with unit supervisors, then she accused another staff of inappropiate sexual contact and then the allegations against Mr. Fairchild... then she states the Chehalis Police Department treated her poorly and made her feel like a victim all over again. Then it was the Prosecutors office, who wouldn't tell her anything or return her phone calls, then Green Hill School staff were treating her "differently and mean mugging her", then she accused the adminsitration at Green Hill School of being "unprofessional and baiting her for information to give back to the Fairchild's", oh wait.....I forgot even her own parents didn't believe her when she came to them about the abuse and repressed memories that she blocked from her childhood....are you all getting the picture here????? Ms. Reed only knows one way of living- either being the center of attention or the victim that has been wronged. I want to again thank the serivce men and woman that are fighting for that very right that gave Ms. Reed the ability to speak about her side and how she has been wronged, but remember that right will go both ways. At some point you are going to have to shift that "victim" light to where it belongs...to Mr. Fairchild

I've been following this story in the chronicle for a long time now and i haven't heard a lot of facts from Christy Reed. It seems to me that she has probably changed her story a couple of times. Enough is Enough lets state some facts. The case was thrown out because Christy side could get her stuff together. This is all public material. If you don't believe me go to the court house and get one. Everett I stand on your side of this story and i know i've picked the right side!!! I hope the chronicle can review the court documents and correct the mistakes that they have already made.

Especialy when the only info you're judging this guy on is the ONE sided tory your getting from a ONE sided Newspaper. Just like last time they wrote a story about this case. I know the truth (facts) to this case and I know who the victim(s)really are! This case was dismissed due to poor work ethics from the Pros. office and evidence that was produced at the hearing(s). I will say that this case is FAR from over and if you want the truth...try the court house. This is a public record!!!
